Please contact us at mail@42.show before dispatching any return or warranty shipment, so that we can issue a return reference number. Parcels sent without prior notice may be refused by the carrier.
1. What we make
Our core activity is custom manufacturing. LED and mirror costumes, props and accessories are produced individually for each customer, to the dimensions, colours, materials and design that the customer specifies. This determines how returns work, and the rules below follow from it. The full terms are set out in Sections 3, 8, 9 and 10 of our Terms and Conditions.
2. Right of withdrawal
Most of our products are excluded from the right of withdrawal. Under Art. 38(1) and 38(3) of the Polish Consumer Rights Act of 30 May 2014 and Art. 16(a) and 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to non-prefabricated goods manufactured to the customer’s own specification or clearly personalised, nor to services fully performed with the customer’s express prior consent. Since we manufacture to order, these exclusions cover the majority of our sales.
Where the right does apply — that is, for standard, non-customised products — a consumer may withdraw from the contract within 14 days of receiving the goods, without giving a reason. Send us a statement by e-mail to mail@42.show, in writing to the return address above, or use our withdrawal form. Using the form is optional: any unequivocal statement is valid. We confirm receipt of every withdrawal statement by e-mail.
3. How a refund is processed
- Send the withdrawal statement within 14 days of receiving the goods.
- Return the goods within 14 days of sending the statement, to the return address above.
- You bear the direct cost of return shipping, any payment-system commissions and any customs duties.
- We are entitled to withhold the refund until we have received the goods back, or until you supply proof that they have been dispatched, whichever occurs first (Art. 32(3) of the Consumer Rights Act).
- On receipt we inspect the goods and photograph their condition.
- The refund is issued within 14 days of receipt of your withdrawal statement, using the same payment method you used, unless you expressly agree otherwise. Card refunds are typically credited within 3–30 days of being issued; bank-transfer refunds go to the originating account.
We refund the cost of the cheapest standard delivery method we offer. If you chose express shipping, the difference is not refunded.
4. Condition of returned goods
You are entitled to examine the goods as you would in a shop — unpack them, check the fit and switch on the electronics. You are liable for any reduction in value resulting from use beyond that (Art. 34(4) of the Consumer Rights Act).
For stage costumes this matters in practice. Use at an event or performance, wear, soiling, odour, damaged or missing mirror elements, altered or shortened garments and removed labels all reduce the value of an item, in some cases to nil. The corresponding amount is deducted from the refund, and we document the condition of every returned item on receipt by photograph.
5. Cancelling a custom order
Where the right of withdrawal does not apply because the order is custom-made, but you nevertheless wish to cancel:
- if production is complete, we are entitled to refuse a refund;
- if the item is still being made, we refund the unused part of the amount paid — the sum paid less the cost of work already carried out and materials and components already used or ordered for your project, calculated in proportion to the work performed (Art. 35 of the Consumer Rights Act; Art. 14(3) and 16(a) of Directive 2011/83/EU).
If a payment was made by mistake, contact your manager and the amount will be returned.
6. Faults, damage and warranty
We are obliged to deliver goods free of defects. In addition, we provide a workmanship guarantee covering faults in the original assembly or in the integrity of the components used — for example short circuits caused by a fault in LED manufacturing or in soldering.
If a parcel arrives with visible signs of damage, record the damage with the carrier at the moment of receipt (damage report, photographs and, where possible, video) and file a claim with the carrier. If you accept a visibly damaged parcel without doing so, we may be unable to provide a refund or replacement.
For damage that is not visible from the outside of the parcel, please provide an unedited video of unpacking and of the first switching-on, together with photographs. Transport-related damage must be reported within 3 days of receipt.
The guarantee does not cover mechanical, electrical or thermal damage to wires, diodes, soldering, insulation or the base; damage caused by improper use, storage or maintenance; normal wear of consumable accessories; or variations within normal manufacturing tolerances, which are inherent in handmade products.
To report a fault, write to mail@42.show (or, if e-mail is not possible, send a WhatsApp text message to +48 665 486 586). Describe the fault, when it appeared, how the product was used, and attach photographs or video. We respond within 14 calendar days. Until the cause is established, the customer bears the cost of transport and inspection; if the fault is covered by the guarantee, we bear the cost of repair including round-trip shipping.
7. Before starting a chargeback
If something has gone wrong with your order, please contact us first — most cases are resolved within a day or two. Opening a payment dispute on a validly performed custom order is treated as a breach of our Terms and Conditions, and we provide payment providers and banks with the order documentation, the agreed specification and proof of performance and delivery.
8. Out-of-court dispute resolution
A consumer may use out-of-court methods of handling complaints and pursuing claims, including through district consumer ombudsmen, the Trade Inspection and the Office of Competition and Consumer Protection (uokik.gov.pl), or through the European Consumer Centre in their country of residence (eccnet.eu). Use of these procedures is voluntary for both parties.
